MEMORANDUM CIRCULAR No. 08-03
TO: ALL OPERATORS, PILOTS AND TRANSPORTERS OF LIVE FISH FROM THE PROVINCE OF PALAWAN
ALL AIR TRAFFIC SERVICES PERSONNEL
SUBJECT: APPROVAL OF FLIGHT PLAN TO AND FROM THE PROVINCE OF PALAWAN.
1. PURPOSE
1.1 In addition to the requirements embodied with the Memorandum Circular # 12-01 dated 17 September 2001 re: Handling of Flight Plan for Domestic Flights.
2. GENERAL
2.1 Pursuant to Republic Act # 776, as amended;
2.2 In relation to the Multi-Partite Memorandum of Agreement (MOA) on the Dissemination, Enforcement, and Monitoring of Compliance with pertinent Laws,Rules,and Regulations, Governing the Trade, Culture, Storage, Transport and Legal Transactions regarding the Live Fish from the Province of Palawan, over which,the Air Transportation Office is one of the principal signatories, herein attached and made as an integral part of this document as Annex "A";
2.3 In connection with the Implementation of Palawan Council for Sustainable Development
(PCSD) Administrative Order (AO) #00-05, herein attached and made as an integral part of this document as Annex "B"; and
2.4 In support with the police power of the state being implemented by the PCSD in
accordance with Republic Act #7611, otherwise known as the "Strategic Plan for
Palawan" (SEP Law), herein attached and made as an integral part of this
document as Annex "C".
3. PROCEDURE
3.1 Aside from the regular requirements embodied with the Memorandum Circular # 12-01 dated 17 September 2001, the following must be complied with:
a.) Operator/s, Pilot/s and Transporter/s must be accredited and must show current accreditation (ORIGINAL) issued by the PCSD, herein attached as Annex "D"; and
b.) Operator/s, Pilot/s and Transporter/s must fill up/accomplish the additional form provided for by the PCSD and attach it to the flight plan form, herein attached and
made as an integral part of this document as Annex "E".
3.2 All flight plans in relation herewith must be relayed by ATS Unit to the PNP-ASG/BFAR/PCSD liaison officer on duty accordingly, for their monitoring and proper disposition.
4. PENALTY
4.1 None compliance therewith, will mean disapproval of the Flight Plan being applied for; and
4.2 Any violation hereof and provisions of Memorandum Circular # 12-01 dated 17 September 2001 and Republic Act # 776 will be dealt with accordingly.
5. REPEALING CLAUSE
5.1 All Orders, Memoranda, Circulars, Publications, and other issuance inconsistent herewith are hereby rescinded.
6. EFFECTIVITY
6.1 This Memorandum Circular shall take effect immediately.
