PCSD RESOLUTION NO. 00-167

RESOLUTION REVOKING THE CONDITIONAL APPROVAL OF THE PROPOSED CEMENT PLANT PROJECT IN QUEZON AND SOFRONIO ESPANOLA, PALAWAN

WHEREAS, R.A. 7611 adopted the Strategic Environmental Plan (SEP) for Palawan as the comprehensive framework that shall guide the local government units in Palawan and the government agencies concerned in the formulation and implementation of environmental plans, programs and projects affecting the province;

WHEREAS, the SEP provides for the establishment of the main strategy, the Environmentally Critical Areas Network (ECAN), a graded system of protection and development control over the whole province involving the designation of management zones and their prescribed uses;

WHEREAS, the Palawan Council for Sustainable Development (PCSD) under the Office of the President is mandated to provide the machinery for the governance, implementation and policy direction of the SEP and pursuant to such mandate the PCSD requires that all projects and undertakings in Palawan must secure SEP clearance prior to implementation in order to ensure that all the activities would be in accordance with the ECAN strategy;

WHEREAS, in 1996, the Central Palawan Mining and Industrial Corporation, Fenway Resources Ltd of Canada, Associated Strategic Investors and Strategic Alliance Development Corporation/P.T. Citra Group of Indonesia and Associates sought the endorsement of the PCSD for the establishment of cement plant, quarrying and other facilities in the Municipalities of Quezon and Espanola;

WHEREAS, the working agreement between the local proponents and their foreign countei'parts have expired and an internal conflict among them has not been resolved, for which reason Mr. Higinio Mendoza, Jr., representing the majority of the claim owners, sought for the revocation of PCSD's conditional endorsement of the project;

WHEREFORE on motion of Hon. Vicente A. Sandoval, duly seconded, the Council resolves, as it is hereby RESOLVED, to revoke, as it is hereby REVOKED, the conditional approval of the establishment of cement plant project in the Municipality of Quezon and Espanola, Palawan;

RESOLVED FURTHER, , that if there are new proponents, who are planning to pursue the project, they shall be required to present a new application to the PCSD and they must undergo the requisite EIA process.

RESOLVED FINALLY, that copies of this resolution be furnished the project proponents, the Department of Environment and Natural Resources, other concerned agencies and NGOs for their information.
