PCSD RESOLUTION NO. 94-65
RESOLUTION ADOPTING A PROCEDURE IN EVALUATING APPLICATIONS FOR NEW LICENSES/PERMITS IN THE UTILIZATION AND OR EXPLOITATION OF NATURAL RESOURCES IN PALAWAN
WHEREAS, R.A. 7611,, otherwise known as the Strategic
Environmental Plan (SEP) for Palawan took effect on 19 June 1992
and Section 16 of said Act provides that the governance, implementation
and policy direction of the SEP shall be exercised by the Palawan
Council for Sustainable Development (PCSD), under the Office of
the President;
WHEREAS, Section 6 of R.A. 7611 also provides that
the SEP shall serve as the framework to guide the government agencies
concerned in the formulation of plans, programs and projects affecting
the environment and natural resources of Palawan ;
WHEREAS, Sections 7-11 of said Act provides for
the establishment of an Environmental Critical Areas Netwrok (ECAN),
the main strategy of SEP wchich is a graded system of protection
and development control over the whole of Palawan, including its
tribal lands, forests, mines, agricultural areas, settlement areas,
small islands, mangroves, coral reefs, seagrass beds and the surrounding
sea ;
WHEREAS, the PCSD, in its 23rd Council meeting
held on 16 February 1994, adopted, through Resolutionn No.94-44,
the guidelines in implementing the ECAN, prescribing among others,
the criteria in establishing the zones, the allowable activities
within the identified zones, and the primordial role of the local
government units in establishing the ECAN In their respective municipalities;
WHEREAS, on 24 November 1993, DENR Region IV Director instructed
the PENRO and all the CENROs in Palawan that all new or renewal
applications for permits/licenses shall be coursed through the PCSD
for comments and recommendations prior to its final evaluation and
possible approval ;
WHEREAS, the PCSD, in its 26th Council meeting
held on 26 July 1994, adopted, through Resolution No. 94-51, a policy
of giving preferential rights to the indigenous cultural communities
(ICCs) of Palawan to collect and gather minor forest products in
the province;
WHEREAS, the PCSD recognized the need to establish
its own evaluation procedures for all new applications pursuant
to R.A. 7611 and related rules and regulations ;
NOW THEREFORE, upon motion by RED Wilfrido Pollisco
duly seconded Cong. Alfredo E, Abueg Jr., all the members of the
Council present;
RESOLVED, as it hereby resolve, to adopt the following
as the procedure in evaluating new applications for permits/licenses
in the utilisation and/ or exploitation of natural resources in
Palawan ;
- The local ( city /municipal) chief executive certifies that
the local government unit concerned interposes no objection to
the application;
- The CENRO and/or PENRO certifies that the application is not
in confilict with an earlier application or existing permit, it
is not 1ocated in any of the protected area or reserves, and whether
or not there is a need for the proponent to undertake an Initial
Environmental Examination and/or a full-blown Environmental Impact
Assessment;
- The PCSD Staff certifies that the application is not in conflict with the allowed activities within the
zones of the Environmentally Critical Areas Network (ECAN) as
regard, the proponent has to submit a map in a 1:50,000 scale
(indicating the proper coordinates), Further, if required, mitigating measures may be suggested by the PCSD Staff;
- If the proposal is located within a proposed or existing ancestral land/domain, as determined by the PCSD Staff the proponent has to acqure an endorsement or waiver from the concerned indigenous cuItural community (ICC) and/ or its ICC leader,
measures may be suggested by the PCSD Staff;
RESOLVED FINALLY, that copies, of this resolution be furnished to all concerned agencies for their information, consideration and appropriate action
