"RESOLUTION IMPOSING AN ADMINISTRATIVE FINE IN THE AMOUNT OF FIFTY THOUSAND PESOS ON PROJECTS AND UNDER TAKINGS IMPLEMENTED WITHOUT SEP CLEARANCE "

WHEREAS, Republic Act No. 7611 adopted the Strategic Environmental Plan (SEP) as the comprehension framework that shall guide the agencies concerned and the local government units in the formulation of plans, programs and projects affecting the environment and natural resources of Palawan;

WHEREAS, Sections 7 to 11 of Republic Act No. 7611 provide for the establishment of the Environmentally Critical Areas Network (ECAN), a graded system of protection and development control over the whole province involving the designation of management zones and their prescribed uses;

WHEREAS, Section 19 of Republic Act No. 7611 empowers the PCSD to adopt, amend and rescind such rules and regulations and impose penalties therefor for the effective implementation of the SEP and pursuant to such power the Council adopted PCSD Resolutions No. 94-44, 99-144 and 99-147 providing for the guidelines in the implementation of the ECAN;

WHEREAS, in order to ensure that projects and undertakings in the province conform with the ECAN guidelines, PCSD Resolution No. 99-146 requires that all projects and undertakings in the province must secure SEP clearance from the PCSD and al 1 agencies authorized by law to issue licenses/permits must require the SEP clearance prior to issuance of any license or permit to applicants;


WHEREAS, in order to effectively enforce the provisions of PCSD Resolution No. 99-146 there is a need to impose an administrative fine if due notice and hearing the PCSD finds that a proponent has implemented projects or undertakings in Palawan without the requisite SEP clearance or accreditation;


WHEREFORE, on motion duly seconded, the Council resolves, as it is hereby RESOLVED, to impose an administrative fine in the amount of fifty thousand (P50,000) for projects or undertakings without SEP clearance.

RESOLVED FURTHER, that the corresponding order be issued for its immediate implementation;

RESOLVED FINALLY, that is the implementing Administrative Order be posted in conspicuous places in the offices of PCSDS and published in local newspaper of genera! circulation in Palawan
