RESOLUTION APPROVING THE JOINT DENR-DA-PCSD ADMINISTRATIVE ORDER FOR THE IMPLEMENTATION AND REGULATION OF R.A. NO. 9147 "AN ACT PROVIDING FOR THE CONSERVATION AND PROTECTION OF WILDLIFE RESOURCES AND THEIR HABITATS, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES"

WHEREAS, The Strategic Environmental Plan (SEP) for Palawan, adopted under Republic Act No. 7611, provides for the comprehensive framework for the sustainable development of Palawan compatible with enhancing the natural resources and endangered environment of the province and created the Palawan Council for Sustainable Development (PCSD) as the administrative machinery for its implementation, governance and policy direction;

WHEREAS, Section 7-11 of said Act provides for the establishment of an Environmentally Critical Areas Network (ECAN), the main strategy for SEP which is a graded system of protection and development control over the whole of Palawan, including its tribal lands, forests, mines, agricultural areas, settlement areas, small islands, mangroves, coral reefs, seagrass beds and the surrounding sea;

WHEREAS, necessary functions and powers have been vested to the Council in order to successfully implement the provisions of this Act found in Section 19, such as: Adopt, amend and rescind such rules and regulations and impose penalties therefor for the effective implementation of the SEP and other provisions of this Act (8); Enforce the provision of this Act and other existing laws, rules and regulations similar to or complementary with this Act (9), and Perform related functions which shall promote the development, conservation, management, protection and utilization of the natural resources of Palawan (10);

WHEREAS, on July 3, 2001, Republic Act No. 9147, otherwise known as the Wildlife Resources Conservation and Protection Act, was passed into law to carry out the declared policy of the State to "conserve the country's wildlife resources and their habitats for sustainability";

WHEREAS, Section 4 of the said Act provides that the PCSD shall be the lead implementing agency in the Province of Palawan pursuant to Republic Act No. 7611 or the Strategic Environmental Plan for Palawan;

WHEREAS, on motion, unanimously seconded by the members present, be it;

RESOLVED, as it is hereby RESOLVED, that the Council APPROVED, the Joint DENR-DA-PCSD Administrative Order Providing a Joint Implementing Rules and Regulations (IRR) Pursuant to Republic Act No. 9147: "An Act Providing for the Conservation and protection of Wildlife Resources and their Habitats, Appropriating Funds Therefor and for other purposes".

RESOLVED FINALLY, that copies of this Resolution be furnished to the Department of Environment and Natural Resources, the Department of Agriculture, the Local Government Units and to other entities concerned for information and appropriate action.
