PCSD RESOLUTION NO. 06-309-A

"A RESOLUTION APPROVING THE LIST OF TERRESTRIAL AND MARINE WILDLIFE IN PALAWAN AND THEIR CATEGORIES PURSUANT TO REPUBLIC ACT 9147, OTHRWISE KNOWN AS THE WILDLIFE RESOURCES CONSERVATION AND PROTECTION ACT"

WHEREAS, on July 30, 2001 Republic Act 9147, otherwise known as the "Wildlife Resources Conservation and Protection Act" was approved to carry out the national policy of conserving the country's wildlife resources and their habitat for sustainability;

WHEREAS, Section 4 thereof provides for the jurisdiction of the Department of Environment and Natural Resources (DENR) and Department of Agriculture (DA) in the nationwide implementation of this Act and in the province of Palawan, the jurisdiction was conferred to the Palawan Council for Sustainable Development (PCSD) pursuant to Republic Act No. 7611;

WHEREAS, Section 22 of the same Act provides that wildlife species or subspecies shall be determined of its classification whether it is critically endangered, endangered, vulnerable or other accepted categories based on the scientific data and with due regard to internationally accepted criteria as enumerated thereof. Further, it states that a List must be published for the purpose which shall be updated regularly or as the need arises;

WHEREAS, in the special meeting on 12 September 2003 the PCSD passed Resolution No. 03-216, approving the joint DENR-DA-PCSD Administrative Order No. 1 entitled "Joint Implementing Rules and Regulations (IRR) pursuant to Republic Act 9147", which is now as PCSD Administrative Order No. 9;

WHEREAS, Rule 4.2 of the aforementioned joint implementing rules and regulations provides that the PCSD pursuant to RA 7611 and Section 4 of RA 9147 shall exercise jurisdiction over all wildlife species found in the province of Palawan, in accordance with the paramount objectives stated in RA 7611 to conserve the species and protect their habitats, consistent with existing national policies on wildlife conservation, management and utilization such as, but not limited to RA 8550 or the Fisheries Code of 1998, RA 8485 or the Animal Welfare Act, and RA 7586 or the NIPAS Act of 1992;

WHEREAS, on 27 February 2004 the PCSD in its 101st Regular Meeting issued and approved PCSD Resolution 04 - 225 entitled "Resolution Adopting the List of Threatened Terrestrial and Marine Wildlife Species in Palawan and other Categories, and the List of other Wildlife Species Pursuant to Republic Act No. 9147, Otherwise Known as the Wildlife Resources Conservation and Protection Act of 2001"

WHEREAS, there is a need to update the List approved in 2004 as the IUCN (International Union for the Conservation of Nature and Natural Resources), CITES (Convention on International Trade of Endangered Species of flora and fauna) and Philippine Red Data have de-listed/upgraded some species from their respective Listings;

WHEREAS, on July 26, 2006, the Environment and Natural Resources Committee of the PCSD in its regular meeting reviewed the above-indicated List and recommended the same to the Council for approval;

WHEREFORE, for and in consideration of the foregoing premises and on motion duly seconded, the Council resolves, as it is hereby RESOLVED to approve the "List of Terrestrial and Marine Wildlife in Palawan and Their Categories Pursuant to Republic Act 9147 otherwise known as the Wildlife Resources Conservation and Protection Act";

RESOLVED FINALLY, that copies of this resolution be furnished the DENR, DA and all other agencies concerned for their information and guidance.
