PCSD RESOLUTION NO. 07-333
"A RESOLUTION RE-OPENING THE PERIOD FOR REGISTRATION OF
TERRESTRIAL AND AQUATIC FLORA AND FAUNA IN THE POSSESSION OF PRIVATE
ENTITIES / INDIVIDUALS AND GOVERNMENT AGENCIES IN PALAWAN PURSUANT
TO REPUBLIC ACT 9147, OTHERWISE KNOWN AS THE "WILDLIFE RESOURCES
CONSERVATION AND PROTECTION ACT"
WHEREAS, on July 30, 2001 Republic Act 9147, otherwise
known as the "Wildlife Resources Conservation and Protection Act"
was approved to carry out the national policy of conserving the
country's wildlife resources and their habitat for sustainability;
WHEREAS, Section 4 thereof provides for the jurisdiction
of the Department of Environment and Natural Resources (DENR) and
Department of Agriculture (DA) in the nationwide implementation
of this Act and in the province of Palawan, the jurisdiction was
conferred to the Palawan Council for Sustainable Development (PCSD)
pursuant to Republic Act No. 7611;
WHEREAS, Section 26 of the same Act requires the
implementing agencies to set a period, within which persons/entities
shall register all threatened species collected and exotic species
imported prior to the effectivity of the Act. Section 26 further
provides that "after the period set has elapsed, threatened wildlife
possessed without the certificate of registration shall be confiscated
in favor of the government;
WHEREAS, in relation to the aforementioned Sections
4 and 26, an implementing rules and regulations was jointly issued
by the DENR, DA and PCSD, Rule 26.1 of which provides that "all
threatened indigenous and endemic fauna, and all exotic species
in the possession of private entities or individuals without permit
from the government agency concerned shall be registered within
the period to be declared. The possessor of said wildlife shall
be issued a Certificate of Wildlife Registration (CWR) for the purpose,
provided such person or entity can prove financial and technical
capability and has the facility to maintain said wildlife;
WHEREAS, the joint implementing rules and regulations
further provides under Rule 26.4 that all Philippine wildlife which
are not listed as threatened prior to the effectivity of R.A. 9147
but which may later be listed as threatened, shall likewise be registered
during the period set;
WHEREAS, the PCSD, in its 113th regular meeting
on December 17, 2004, adopted DENR's DAO 2004-62 (Prescribing Fees
and other guidelines pertaining to the registration of threatened,
non-threatened and exotic faunal species under the jurisdiction
of the DENR), which is contained in PCSD Resolution No. 04-243;
WHEREAS, certain provisions of the above DAO 2004-62
were waived and amended by the DENR as reflected in DAO 2004-65,
specifically on registration fees, that therein a lower registration
fees at the minimum of PhP 50.00 for every 1 to 50 heads of a particular
wildlife species were imposed;
WHEREAS, the registration of terrestrial wildlife
fauna was conducted in Palawan on March 22, 2005 to April 22, 2005,
the registration period declared by the Council as reflected in
PCSD Resolution No. 05-245;
WHEREAS, the aforementioned registration resulted
to only 2, 1, 5 and 90 individuals who filed an application for
registration in the Northern, Calamianes, Southern and Central District
Management Offices (DMOs) of the PCSD, respectively, because most
of the owner who did not apply for such claimed that they could
not afford to pay for the registration and other fees as required
and imposed by the PCSD;
WHEREAS, the PCSD Staff found it necessary to set
another registration period and, to include aquatic resources for
inventory purposes as the above registration results do not serve
the purpose of managing, conserving and protecting all wildlife
resources in captivity. Further, due to the clamor and request of
several establishments including pet owners and hobbyists to lower/reduce
the registration fees which were imposed during the above-indicated
registration period, re-opening of registration period is necessary
to address this concern;
NOW THEREFORE, for and in consideration of the
foregoing premises and on motion duly seconded, the Council resolves,
as it is hereby RESOLVED to set the period from
September 1, 2007 to December 1, 2007 as registration period of
terrestrial and aquatic flora and fauna in possession of private
entities / individuals and government agencies in the Province of
Palawan, pursuant to Republic Act No. 9147;
RESOLVED FINALLY, that copies of this resolution
be furnished all the agencies concerned for their information and
guidance.
